1. Information about the operator
This website (omnitech.com.co, the "Site") is operated by OmniTech Software S.A.S., a company incorporated under the laws of the Republic of Colombia, registered under tax ID (NIT) 901.821.996-1, with registered offices at Carrera 70 # 7B-24, Apto. 201, Bogotá D.C., Colombia ("OmniTech", "we", or "the Company"). 2. Purpose and acceptance
These Terms and Conditions (the "Terms") govern access to and use of the Site by any visitor (the "User"). The Site is informational and promotional in nature regarding OmniTech's software engineering services: it does not constitute a binding contractual offer and does not, by itself, create any commercial relationship. Any provision of services between OmniTech and a client will be governed by a separate written agreement.
By accessing the Site, the User confirms having read, understood, and accepted these Terms. If you do not agree with any of the provisions, do not use the Site.
3. Eligibility and permitted use
Users must be of legal age or have the authorization of a legal representative. The Site may be used only for lawful purposes and in accordance with these Terms. The following is expressly prohibited:
- Using the Site for fraudulent, illegal, or bad-faith purposes.
- Reverse engineering, unauthorized scraping, decompiling, or attempts to access systems, data, or areas not intended for the public.
- Introducing malicious code, viruses, or any element that could affect the integrity or availability of the Site or third-party systems.
- Impersonating OmniTech, its personnel, or any other person.
- Reproducing, distributing, or publicly communicating the Site's content without prior written authorization.
4. Intellectual property
All elements of the Site — including, without limitation, the name OmniTech, its logotype and wordmark, taglines, visual identity, color palette, typography, text, illustrations, images, animations, source code, structure, and design — are the property of OmniTech or its licensors and are protected under Colombian and international intellectual and industrial property laws.
Access to the Site grants the User no license or right over these elements, except a limited, non-exclusive, non-transferable, revocable right to view them for personal, non-commercial use.
Third-party trademarks, trade names, or logos that may appear on the Site (for example, in references to clients or technologies) belong to their respective owners.
5. Content and availability
OmniTech endeavors to keep the Site's information accurate and up to date but does not warrant that it is free from errors, omissions, or outdated material. Content is general and informational and should not be construed as technical, legal, or financial advice.
OmniTech may modify, suspend, or discontinue the Site or any of its sections, in whole or in part, at any time and without prior notice, for reasons of maintenance, security, product evolution, or other operational considerations.
6. Third-party links
The Site may contain links to third-party websites or resources. OmniTech does not control and is not responsible for the content, privacy practices, or availability of those sites. The inclusion of a link does not imply endorsement, recommendation, or commercial relationship with the third party.
7. Contact form
The Site provides a form for the User to initiate a commercial conversation with OmniTech ("Start a project"). Submitting the form does not constitute an offer or a contract; it is an expression of interest that OmniTech may respond to, not respond to, or route internally at its discretion. The processing of personal data submitted is governed by the Privacy Policy.
8. Limitation of liability
To the maximum extent permitted by applicable law, OmniTech shall not be liable for indirect, incidental, or consequential damages, lost profits, or loss of opportunity arising from access to or use — or inability to access or use — the Site. OmniTech's aggregate liability to any User for any claim related to the Site is limited to one hundred thousand Colombian pesos (COP 100,000) or its equivalent in foreign currency.
This limitation does not apply to damages that, under Colombian law, cannot be excluded or limited contractually (including willful misconduct or gross negligence).
10. Changes to the Terms
OmniTech may update these Terms at any time. The version in force will always be the one published on the Site, identified by its update date. Continued use of the Site after a change implies acceptance of the modified Terms. Users are encouraged to review this page periodically.
11. Severability
If any provision of these Terms is declared invalid, illegal, or unenforceable by a competent authority, the remaining provisions will remain in full force and effect.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Colombia. Any dispute arising out of or relating to them shall be submitted to the ordinary civil courts of Bogotá D.C., Colombia, without prejudice to mandatory consumer protection or data protection rules applicable to the User.
